Letter – Nicholas Walton to William Corbett – 2 Dec 1748

Sir                  

      The Leases of Dilston and Lorbottle Tythes for 21 years granted to us as part of the Derwentwater Estate, by the Dean & Chapter of Carlisle, of which there is a Term of Seven years expired, we have applied to the said Chapter to have renewed as is usual at the end of every seven years, & they have given for answer that they will not renew till some points they insist upon are complied with.  Mr Boag attended the Chapter the 23rd Ult. & inclosed you have their minute of what they insist upon, to which we beg leave to refer, & have only to add that it is our opinion the Hospital should have these Leases renewed. That as the Derwentw’r Estate has had the Profits of these Tyths undr the several grants of ‘em from the Dean & Chapter of Carlisle, it seems reasonable that the lessors should be indemnified & was the intention upon the late Renewals by the Covenant from us the Lessees for that purpose. That in regard to the Security of £2000 required, we submit it to the Board’s Consideration whether that be reasonable for them to comply with; but we think it is not very material what the Security is, if the Board are of opinion the Lessors ought to be indemnified.  In regard to the 16s/6d per Ann. pay’ble to them out of Corbridge, it is true that such a Rent was due, & that it has not been paid for these 10 years last past, being forfeited to the Crown for want of Claim being made thereto after the Rebellion in 1715. [Minutes from Dean and Chapter of Carlisle]     

Carlisle       November 23rd 1748



      Mr Boag having applied to the Dean and Chapter of Carlisle for the renewal of two leases of the Tythes of Lorbottle and Dilston lately belonging to the Earl of Derwentwater (and as part of the forfeited Estates) since granted to the Lords of the Treasury and the Commissioners of Greenwich Hospital or their Agents under Indemnities from the Lessees.



The Dean and Chapter say,

      That having been engaged in a long Law Suit in the Court of Exchequer not yet ended they are not willing to venture on further renewals of these Leases before the Charges are paid that have accrued upon this Suite and until they have a fresh Indemnity in a Bond of £2000 against any Demands that may be made or any further Suit or Trouble that may arise to them or their Successors on Accot. of the former and present Renewals of the said Leases.

      And the said Dean and Chapter farther say that a yearly customary Rent of 16s/6d due to them out of an Estate held under them as Parcel or Part of their Manor of Corbridge by the Custom of the said Manor.  The Freehold of which Estates is the undoubted Right and Property of the of the Dean and Chapter as Lords of the Manor of Corbridge has been withheld for ten years last past notwithstanding the Dean and Chapter at the last Renewal apprehended they were promised to be made easy as to this Rent without putting them to farther Trouble for recovery of the same.

      These Points complied with and settled the Chapter are ready to renew upon the usual Terms.
