Sir     

      I have the favour of yours by this post and am surprised you have heard nothing from Mr Simpson, from whom I have a Letter this Post in which he acquaints me he has reced. a Letter from his Agent in London in wch. he says notwithstanding the notice of a declaration being filed no such thing is yet Filed, or delivered, so that he hopes the Plaintiff will not proceed.  I have no copy of the notice of declaration served on Nicholson but I have wrote to Mr Simpson and acquainted him by this Post, that you have not reced. any Letter from him and have desired he will send you a Copy of the notice and what else is necessary.  Indeed I understood he had done all this & I am surprized you have heard no thing from him.  I wrote to Mr Horne & stated the Facts as to this matter the 14th inst. so that you will no doubt have had directions from the Board.
